Overview of EA 2022 Amendments

The Employment Act 1955 was significantly amended in 2022, expanding coverage and adding new protections for employees. Changes took effect from 1 January 2023.

Key Changes

1. Extended Coverage

The Act now covers all employees earning up to RM4,000/month (previously RM2,000). This brings millions more Malaysians under EA protection.

2. Working Hours

Maximum working hours reduced from 48 to 45 hours per week. Overtime must be paid at 1.5x the ordinary rate.

3. Paternity Leave

Fathers now entitled to 7 days paid paternity leave (previously not in the Act).

4. Flexible Work Arrangements

Employees may request flexible working arrangements. Employers must respond in writing within 60 days.

5. Sexual Harassment

Strengthened provisions including mandatory inquiry procedures and protections for victims.
